Portal Vision Terms of Use
These Terms govern the purchase and use of Portal Vision — the program installed on the customer's computer (the "Station"), the web platform (app.portalvision.com.br) and the results dashboard — provided by Portal Vision, Brazilian company registration (CNPJ) 13.647.263/0001-39, Vila Velha, ES, Brazil ("we"). By ticking the acceptance box at purchase, by creating an account or by installing the program, you (the "Customer") agree to these Terms and to the Privacy Policy.
1. What the service is
Portal Vision is a subscription service that turns cameras already installed at the Customer's premises into a people and vehicle counter. It consists of:
- Station: the Windows program installed on a Customer computer on the same network as the cameras. It analyses the images locally and produces the counts.
- Platform: the website where the Customer manages the account, sites, cameras, users and licenses, and monitors the stations.
- Dashboard: the screens with the results (entries, exits, people present, footfall, zones, heat map, traffic, reports).
The service is provided for the Customer's business use, within the limits of the plan purchased.
2. Account and access
- To subscribe, the Customer provides a name or company name, tax identification number, e-mail, phone number, city and country. The details must be true and kept up to date; they are used to create the access, issue invoices and comply with tax rules.
- Initial access is delivered with a temporary password, changed on first use. The Customer is responsible for keeping passwords safe and for the accesses it creates for other people (administrators, managers, viewers), which it can revoke at any time on the platform.
- The Customer must be at least 18 years old and, when subscribing on behalf of a company, must have authority to represent it.
3. Free trial
The Station program can be downloaded and used free of charge for 14 days from installation, with no credit card and no commitment (the "transition period"). During this period all counting features are available. At the end of the 14 days, if no license has been assigned, the Station remains installed, showing the images and accepting settings, but stops recording counts until a subscription is purchased. Nothing is charged automatically at the end of the trial.
4. Plans, price and payment
- The price is calculated per camera subscribed, according to the price list published on the website at the time of purchase, on a monthly or annual cycle (the annual cycle carries the discount shown on the website). The amount shown at purchase is the amount charged.
- Customers in Brazil pay in Brazilian reais through Asaas Gestão Financeira S.A. (Pix, bank slip or credit card). Customers outside Brazil pay in US dollars by credit card, through an international payment processor named on the invoice; until online checkout is available, the subscription is set up by e-mail. We do not store card details: they are entered directly with the payment processor.
- Access, link code and license are released automatically once payment is confirmed (card payments usually within minutes; bank slips in Brazil within 3 business days).
- The license covers the number of cameras subscribed. If the Customer activates more cameras than the plan covers, the excess cameras do not count until the plan is expanded; the platform warns when this happens. The plan can be expanded at any time.
- We may change the price list for new subscriptions at any time. For subscriptions in force, any price change is notified by e-mail at least 30 days in advance and applies from the next renewal.
- Invoices are issued to the tax identification provided at purchase. Taxes applicable in the Customer's country (such as VAT or sales tax) are the Customer's responsibility unless the invoice states otherwise.
5. Renewal, late payment and suspension
- The subscription renews automatically at the end of each cycle (month or year), with a charge issued to the registered e-mail, until the Customer cancels.
- If a charge is not paid by its due date, there is a 7-day grace period during which everything keeps working. After that the license is suspended: the Station stops recording counts and sending measurements, and the dashboard stops receiving new data. Data already recorded and access to the platform are kept.
- On payment, the license is reactivated automatically, usually within minutes.
- A refund request through the card issuer (chargeback) or confirmed fraud authorises immediate suspension.
6. Cancellation and refund
- The Customer may cancel at any time, on the platform or through the contact channels, with no penalty. The service remains available until the end of the period already paid; there are no further charges and no pro-rata refund of the current period, except as provided below.
- Money-back period: the Customer may withdraw from a purchase made online within 7 calendar days of payment and receive a full refund by the same payment method. Simply ask by e-mail or WhatsApp, quoting the tax identification and the e-mail used at purchase. Where the Customer's local consumer law grants a longer period, that period applies.
- We may terminate a subscription for breach of these Terms (fraudulent use, license violation, unlawful use of the service), with notice by e-mail. In that case, amounts paid for the unused period are refunded unless termination results from fraud.
- After termination, account data remains available for 90 days for export (CSV) and may then be deleted, except for what the law requires us to keep (tax and access records).
7. License
- We grant the Customer a personal, limited, non-exclusive and non-transferable license to install and use the Station on the Customer's own computers, within the number of cameras subscribed, while the subscription is active.
- Each license is tied to the computer on which it was activated. Changing computers is done on the platform (release the license and activate it on the new PC); the number of changes may be limited in case of abuse.
- The Station must communicate periodically with our servers to confirm the license. Without contact for more than 7 consecutive days it stops counting until the connection is restored; counts made while the license is valid but the internet is down are stored and sent when the connection returns.
- It is forbidden to: copy, rent, sublicense or resell the program; reverse-engineer, decompile, modify or circumvent the license mechanisms; use the service for unlawful purposes or to monitor people in a manner contrary to law.
- Resellers and partners operate under their own agreement; these Terms apply to the end Customer.
8. What the service does and does not do
- Counts are produced by artificial intelligence from the camera images and are estimates. Accuracy depends on camera position, lighting, image quality, the computer and how lines and zones are drawn, following the guide. Differences from a manual count are expected and do not constitute a defect.
- Portal Vision does not identify people: no face recognition, no age or gender estimation, no license-plate reading and no re-identification of a person across cameras. It counts silhouettes.
- The service is not a security, access-control, surveillance or recording system and must not be used for decisions that require exactness or to monitor individuals. Speed measurements from the traffic module are indicative and have no enforcement value.
9. Customer responsibilities
- Provide and keep in working order the cameras, the network, the Station computer and the internet connection, according to the minimum requirements published on the website and in the guide.
- Act as controller of the images captured by its cameras, complying with the law applicable to video capture at its premises (including camera signage and data-protection law such as GDPR or LGPD), as set out in section 13.
- Use the service only for counting and flow analysis at its own premises or at those of customers who have authorised it.
- Keep registration and billing details up to date and keep access credentials safe.
10. Availability, updates and support
- We work to keep the platform continuously available but do not guarantee uninterrupted operation: there may be maintenance stops (announced when scheduled), third-party failures (hosting, internet, payment processors) and force majeure. The Station keeps counting locally during platform outages, subject to the limit in section 7.
- The Station is updated automatically from our servers, with a backup taken before each update. Old versions may cease to be supported.
- Support is provided during Brazilian business hours, by WhatsApp and e-mail, for the program, the platform and the configuration of the counts. It does not include physical camera installation, cabling, or configuration of the Customer's network or recorder (DVR/NVR). With the Customer's authorisation, support may access the Station remotely through the platform; such accesses are logged.
11. Limitation of liability
To the extent permitted by law, we are not liable for lost profits, loss of revenue, business decisions taken on the basis of the counts, or indirect damages. Where we are liable, our liability is limited to the amount paid by the Customer in the 12 months preceding the event. Nothing in these Terms excludes rights that mandatory consumer law grants the Customer.
12. Intellectual property
The program, the platform, the dashboard, the Portal Vision brand, the texts, screens and documentation are owned by or licensed to us. The subscription transfers no right beyond the license in section 7. The count data generated from the Customer's cameras belongs to the Customer, who may export it; we may use aggregated and anonymised data (without identifying the Customer) to improve the service and produce statistics.
13. Personal data and images
- Camera images are processed on the Customer's computer and are not sent to our servers. What travels are numbers (counts per line, per hour, zone occupancy, heat-map grids) and, for the heat map, a background frame captured with no people in it. Details in the Privacy Policy.
- With regard to its camera images, the Customer is the controller and we are a processor only of the aggregated data we receive. It is up to the Customer to inform people about the cameras at its premises, as required by applicable law.
- Remote access to the Station through the platform (which shows the live image) is only performed by users authorised by the Customer or by our support, and is logged.
14. Changes to these Terms
We may update these Terms to reflect changes in the service or in the law. The current version is always published on this page, with its date. Material changes are notified by e-mail or on the platform at least 15 days in advance; if the Customer does not agree, it may cancel the subscription before they take effect, at no cost.
15. Governing law and jurisdiction
These Terms are governed by the laws of the Federative Republic of Brazil. Disputes are submitted to the courts of Vila Velha, ES, Brazil, without prejudice to mandatory consumer-protection rules of the Customer's country of residence that grant jurisdiction to its local courts.
16. Contact
Questions, cancellation or refund requests, or any other matter: [email protected] or the WhatsApp number shown on the website.
